Genentech, a member of the Roche Group, seeks an experienced, collaborative privacy attorney to join the Legal Department as Senior Counsel Specialist, Assistant General Counsel, reporting to the company's Chief Privacy Officer in the Genentech Privacy Office. This position will be responsible for advising on and promoting compliance with data protection and privacy laws and regulations affecting business activities primarily in the United States. 

This role will be located on our South San Francisco campus, and a fully remote working arrangement is not available.  Relocation benefits are not available for this posting.  

Responsibilities:

  • Act as a key internal point-of-contact and subject matter expert on privacy and data protection, providing practical, timely, strategic, and high-quality legal advice on data privacy and security matters. 

  • Serve as an internal escalation point to legal, compliance, and contracting colleagues on complex privacy legal issues. 

  • Assist business stakeholders in understanding and addressing data protection and privacy issues in the development of new products and technologies and in connection with data collection, use, and sharing.

  • Proactively identify opportunities to create value to business and legal colleagues and manage legal issues, fostering strong relationships with client groups and legal colleagues, creating efficient and effective processes for working with clients, advising senior business leaders, and acting as a standing or ad hoc member of business or leadership teams. 

  • Develop and implement internal policies, guidance, and training materials.

  • Support incident planning and response and advise on investigations regarding inappropriate or unauthorized access, loss, or disclosure of personal data. 

  • Advise the Data, Digital and Analytics team, IT Security, Compliance, and other individuals with privacy and data handling responsibilities, supporting strategy setting and management of complex privacy matters involving systems and data processing activities.

  • Monitor developments and trends in data protection and privacy laws, regulations, and enforcement, and support compliance with emerging laws.

  • Assist with external policy, legislation, and litigation related to privacy and data security.

  • Collaborate with global colleagues in the Roche Data, Digital, & Privacy team and local affiliate privacy offices on privacy legal matters and compliance initiatives.

Requirements:

  • A U.S. law degree (J.D.) and current “good standing” admission to at least one U.S. state bar, or be eligible to apply to California’s Registered In-House Counsel program

  • 12+ years of experience as a practicing attorney, in-house and/or at a law firm, including at least 5+ years of direct, hands-on experience providing legal counseling on data privacy and security matters to biotechnology and/or pharmaceutical companies. 

  • CIPP/US certification required; AIGP certification is a plus. 

  • Subject matter expert on requirements of data protection and privacy legal issues affecting the business activities of a research-based biotechnology company, including scientific research involving patient-derived data, clinical trials, patient support services, digital marketing, intra- and inter-company business transactions, and consumer protection.

  • Comprehensive understanding of relevant statutes, regulations and guidance, such as comprehensive state privacy laws, Section 5 of the FTC Act, California Confidentiality of Medical Information Act (CMIA), Washington My Health My Data Act, state breach notification laws, HIPAA, EU General Data Protection Regulation (GDPR), TCPA, and CAN-SPAM. 

  • Understanding of the emerging AI legal landscape, including knowledge of the requirements of the Colorado AI Act and related legislation.

  • Substantial experience assessing and practically mitigating privacy and data protection legal risks.

  • Experience with data loss prevention and cybersecurity events, including forensic investigations, breach notifications, and cybersecurity preparedness.

  • Excellent negotiation and communication skills, both oral and written.

  • Ability to deliver clear, concise and practical advice regarding challenging legal issues to legal and non-legal colleagues, including senior management.

  • Experience and interest in new and emerging technologies, including in the areas of AI/ML and personalized healthcare.

  • Strong organizational skills, ability to multitask and prioritize effectively, take initiative, lead projects, and work independently and collaboratively with others.

  • Detail-oriented, self-motivated, and able to motivate others.

  • A strong commitment to integrity and professionalism and demonstrated passion for excellence. 

The expected salary range for this position based on the primary location of California is $209,700 to $389,500. Actual pay will be determined based on experience, qualifications, geographic location, and other job-related factors permitted by law.  A discretionary annual bonus may be available based on individual and Company performance.  This position also qualifies for the benefits detailed at the link provided below.
