About the Role

We’re looking for Marketing & Privacy counsel to join our growing legal team and support a broad, high-volume range of marketing efforts. We’re looking for someone excited to think broadly about our business and roll up their sleeves to help us deliver world-class legal services to our business partners.

What You'll Do

  • Conduct legal review of pre-publication marketing content across all media (social, TV, radio, print, and internet) in all markets. Sidecar Health is currently available in 16 states, with expansion efforts ongoing.
  • Advise the marketing team on legal risks, considerations, implications, and guardrails related to various marketing campaigns (e.g., acquisition and retention, PR efforts, talent engagement, referral rewards, sweepstakes/contests, testimonials and endorsements, etc.).
  • Advise, as needed, product and engineering teams on general privacy-related matters.
  • Develop and implement of trademark strategy, including maintaining and enforcing trademark portfolio, conducting trademark searches, identifying registration opportunities, and managing outside counsel
  • Keep up to speed on the latest developments in advertising laws, rules, and regulatory principles and providing counsel on industry-specific marketing issues, including unfair trade practices under state insurance laws, CAN-SPAM, TCPA, privacy, and other laws specific to e-commerce and the sale of health insurance.
  • Assist, as needed, with review and negotiation of commercial contracts related to marketing initiatives (e.g., vendor agreements, programmatic advertising insertion orders, master terms and conditions with advertisers and agencies).

What You'll Bring

  • 5+ years of relevant experience, particularly working as in-house counsel in an insurtech or insurance carrier, preferably in the health insurance space.
  • JD; admitted to a U.S. state bar. If located in California, California State Bar membership is preferred. At a minimum, the candidate must be qualified for and quickly acquire a Registered In-House Counsel status in California and the willingness to maintain that status during employment.
  • Deep knowledge of federal and multi-state advertising, consumer protection, and data privacy laws and regulations applicable to insurance and e-commerce, including, and especially, HIPAA.
  • Familiarity with the media buying and ad tech ecosystem, including affiliate marketing, ad networks, DMPs, connectivity platforms, and types of advertising inventory.
  • Understanding of technology, the internet, and use of data for marketing campaigns (e.g., use of beacons, cookies, and cookie alternatives across devices, programmatic technologies, and matching of datasets).
  • Proactive and solution-oriented with the ability to work in a fast-paced environment and balance legal risk against business objectives.
  • Collaborative, communicative, and highly organized with the ability to prioritize multiple projects while driving them to completion.
  • Self-motivated with an ability to work independently and a passion for increasing efficiency through continuous process improvement.
