JOB DESCRIPTION:
Essential Duties & Responsibilities
- Defends the insured employer by participating in hearings, mandatory settlement conferences, depositions and trials where they examine witnesses, offer evidence and argue their case.
- Is accountable for timely preparing hearing, deposition, settlement conference briefs, pre-trial and status reports on their pending files.
- Responsible for one time appearances, walk though settlements, liens, Lien trials, and full handling on permanent files under attorney supervision.
- Investigates and negotiates lien claims and defends our insured employers at lien trials.
- Regularly communicates with Claims Professionals and meets with CNA insureds to discuss their defense.
- Provides research, factual information, counsel and guidance and seminars to claims adjusters on legal questions or issues relating to their workers? compensation claim files.
- Responsible to resolve legal cases under attorney supervision.
- Responsible for meeting staff counsel billing requirement.
Skills, Knowledge and Abilities
- Knowledge and application of theories and principles of litigation management within a claims organization.
- Strong technical expertise, sophistication, and independent judgment to manage internal and external business relationships.
- Strong verbal and written communication skills.
- Strong analytical and negotiation skills.
- Ability to deal with ambiguous situations and issues.
- Creativity in solving unique and challenging problems.
- Knowledge of Microsoft Office Suite as well as other business-related software.
- Comprehensive knowledge of the rules and regulations and laws pertaining to handling Workers? Compensation cases at the WCAB. Familiarity with the policies and procedures and litigation strategies involved in preparing and litigating cases at the WCAB.
- Skilled in deposition, negotiation, and trial techniques and case resolution.
Education and Experience
- Bachelor's degree, in a related discipline, or equivalent.
- Typically a minimum of four years of related work experience.
