As Claims Counsel, you will be a technical resource within the Hagerty Claims Organization. You will conduct legal research and assist with providing consistent interpretation and application of policy coverage among all jurisdictions. You will review and assist with responses to coverage rebuttals, coordinate with Corporate Legal on specified matters of regulatory compliance and assist with training for Claims Department coverage related issues.

What You’ll Do

Coverage Analysis

  • Provide Support to Claims Management: Work closely with the Claims Department, offering day-to-day assistance and serving as a key resource on coverage issues and claims matters.
  • Review Policies & Provide Opinions: Review and analyze insurance policies to determine coverage and liability issues, issuing clear and concise written coverage opinions as needed.
  • Coverage Position Letters: Assist in drafting and refining coverage position letters, ensuring accuracy and clarity.
  • External Counsel Oversight: Review outside counsel’s coverage opinions and provide guidance on coverage strategy and tactics.
  • Policy Wording & White Papers: Review proposed policy wording upon request and prepare white papers on coverage-related topics of interest.

Claims Management

  • Legal Advice & Collaboration: Provide legal advice on a variety of coverage issues arising out of claims handled by the Claims Department; collaborate with claims professionals to resolve coverage disputes and negotiate settlements.
  • Strategic Discussions: Participate in strategic discussions with claims management to offer legal perspectives on coverage matters and claims handling issues.
  • Quarterly Reporting: Prepare quarterly reports for Claims Management, communicating key performance metrics, identifying trends in coverage issues, and recommending training or corrective actions as needed.
  • Communication with Underwriting: Maintain open lines of communication with Underwriting regarding coverage issues and emerging risks.

Litigation Support

  • Coverage-Related Litigation: Manage and oversee coverage-related litigation, including reviewing draft declaratory judgment actions, collaborating with outside counsel, and coordinating internal resources.
  • Document Preparation: Draft or review legal documents, pleadings, and filings to ensure all aspects of coverage positions are articulated and supported.

Legal Research

  • Case Law Monitoring: Conduct ongoing legal research, monitoring case law and emerging developments related to coverage issues; keep stakeholders informed of critical changes.
  • Regulatory Awareness: Stay current on regulatory changes affecting the insurance industry, advising management on potential impacts and necessary policy or procedural updates.

Training & Education

  • Coverage Training: Provide training and guidance to claims adjusters and other staff on coverage issues, best practices, and emerging trends.
  • Internal Presentations: Present on coverage-related topics to both Claims and Underwriting teams, ensuring alignment and consistent understanding of legal perspectives.

Risk Management

  • Identify & Mitigate Legal Risks: Proactively identify potential coverage- or claims-related legal risks, develop mitigation strategies, partner with Regulatory Compliance on any potential compliance issues identified and advise leadership on regulatory and compliance matters.
  • Special Projects: Assist with special projects as requested, applying legal expertise to ensure organizational compliance and effective risk management.

This might describe you

  • Education: Juris Doctor (JD) degree from an accredited law school.
  • Experience: Minimum of 3 years of experience in insurance coverage law, with a focus on auto insurance preferred. Prior experience working in-house for an insurance company is a plus.
  • Skills: Strong analytical and problem-solving skills. Excellent written and verbal communication abilities. Proven ability to manage multiple tasks and work collaboratively with internal teams and external partners.
  • Licensing: Admission to a state bar
  • Knowledge: In-depth understanding of insurance coverage principles, litigation procedures, and regulatory requirements in the insurance industry.

Other things to note 

  • This role can be worked from any U.S. remote location. 
  • Familiarity with public company requirements, including Sarbanes Oxley and key regulations, if applicable. For SOX compliant roles, responsible for designing, executing, and documenting internal controls where they have been identified as owners to prevent errors in financial reporting, processes, and business operations. Including attestation to the completeness, accuracy, and compliance of all financial reporting data, where applicable.
